1. Use of the Site

1-1 Introduction

Thank you for visiting our website. This website is owned and operated by Idemitsu Kosan Co.,Ltd. (“Idemitsu” or “we”). Please read the following guidelines (these “Guidelines”) carefully before using this website.
(1) These Guidelines set forth the terms and conditions of use for websites operated by Idemitsu or its group companies for users in Japan and overseas, to which these Guidelines are applied by linking to these Guidelines or by other means (the “Site(s)”).
(2) These Guidelines shall apply to all users of the Sites ( “User(s)”).

1-2 Disclaimer

(1) Idemitsu shall not be liable for the provision of various services or information on the Sites, or for any delay, change, interruption, suspension, discontinuance, or abolition thereof, or for any other damages incurred by Users or third parties in connection with the Sites.
(2) Idemitsu does not guarantee the accuracy, reliability, usefulness, currency, legality, or morality of the information or services provided on the Sites, or information obtained by Users through the Sites or e-mails sent by Idemitsu. Accordingly, Idemitsu shall not be liable for any damages incurred by Users or third parties in connection with the information or services provided on the Sites or information obtained by Users through the above-mentioned means.
(3) Idemitsu provide links on the Sites only for the convenience of Users, and has no knowledge of, and shall not be liable for any information or services provided by our group companies, business partners, or other entities or individuals who manage or operate the linked website. Use of linked websites is at Users’ own risk and subject to the terms and conditions set out on such websites.
(4) Idemitsu does not recommend the use of any linked websites on the Sites, and has no knowledge or responsibility for the products, services, or companies listed on such linked websites. We shall not liable for any matters related to the linked websites.

1-3 Prohibitions

When using the Sites, the following acts are prohibited:
(1) Acts that cause or may cause disadvantage or damage, infringe on the assets or privacy, or damage the reputation or credibility of Idemitsu or a third party;
(2) Acts that are or may be violate public order and morals, criminal acts, or acts that lead or may lead to criminal acts;
(3) Acts of spoofing, such as registering someone else’s e-mail address, or making false declarations or notifications;
(4) Use or provision of computer viruses or other harmful programs, or acts that may lead to such use or provision; and
(5) Acts that violate or may violate laws and regulations or ordinances, or any other acts that Idemitsu deems inappropriate.

1-4 Intellectual Property

Copyrights, trademarks, and other intellectual property rights related to the information, content, trademarks, logos, images, audio, etc. on the Sites belong to Idemitsu unless otherwise specified.
It is strictly prohibited to use, reproduce, modify or transfer or duplicate, in whole or in part, any of these materials beyond the scope explicitly permitted by law, including for private use or other purpose, without the prior written consent of Idemitsu.
Product names and other names provided on the Sites may be not necessarily marked with a trademark symbol (R, TM).

1-5 Compensation for Damages

(1) In the event a User causes or may cause damage to Idemitsu due to an act in violation of these Guidelines or an unauthorized or illegal act, Idemitsu reserves the right to seek an injunction against such actions and claim compensation for any damages incurred from the User.
(2) Idemitsu shall not be liable for any damages incurred by a User (including damages incurred by Users as a result of trouble with a third party) as a result of such User’s use of the Sites or inability to use the Sites for any reason.
(3) Notwithstanding the provisions of the preceding paragraph, Idemitsu shall be liable to compensate a User for damages incurred by the User based on a breach of contract or unlawful act by Idemitsu in connection with the use of the Sites, up to the amount of such User’s actual damages that would normally result from the attributable cause of such act. However, Idemitsu shall not be liable for any incidental damages, indirect damages, special damages, consequential damages, accidental damages, or future damages or lost profits. The limitation of liability for damages under the provisions of this paragraph shall not apply in the case where Idemitsu has acted intentionally or with gross negligence.

1-6 Links to the Site

In principle, Users are free to link to the Sites, but Idemitsu recommends that Users link to the top page of its corporate website (https://www.idemitsu.com/jp/index.html) because the URL of each page is subject to change or deletion, and the link may be broken.
No application is required if the following conditions are satisfied. User requiring banner images should contact the Company separately.
(1) Please be sure to indicate that the link is a link to the Site in the place where you set the link.
(2) Please be sure to use a separate window to display the link alone. Display within frames or in combination with link sources or other content is not permitted.
(3) If the link is not in line with the purpose of Idemitsu, or if the link may damage the Company’s business or reputation, the Company will refuse the link itself, even after the fact.
(4) The use of company logos, symbols, images, etc. used on this website as link buttons is prohibited. Please link from one of the following strings: “出光興産(株)” “Idemitsu Kosan Co.Ltd.“

1-11 Governing Law and Jurisdiction

(1) These Guidelines shall be governed by and construed in accordance with the laws of Japan.
(2) The Tokyo District Court shall have exclusive jurisdiction as the court of the first instance over any dispute arising between Users and Idemitsu arising out or connected with these Guidelines or the Sites.

2-2 About the Information Collection Module

We use the following information collection modules on the Sites for purposes such as improving the Sites, measuring usage, and providing optimal advertising. An information collection module means a program created by a third party that is independent of the functionality of the website itself and analyzes elements such as the display of advertisements and the frequency of website usage. Users not wishing to have their information collected can stop the collection of information and deactivate the advertising service by changing the settings on their own device.

Information collected by Google Analytics is stored on server systems managed by Google. 2-3 Encryption of Communications

The Sites use SSL (Secure Sockets Layer protocol)* encryption to protect the confidentiality of information that Users enter in inquiry and other forms and send to Idemitsu.

*SSL is a technology that encrypts communications between a browser and a web server. This improves security because Users’ personal information is encrypted. A browser that supports SSL communication is required In order to use SSL.
